These Terms of Service (“Terms”) govern your access to and use of CipherGap, a post-quantum TLS readiness and cryptographic exposure monitoring service operated by HighGround Labs, LLC (“CipherGap,” “we,” “us,” or “our”).

By using CipherGap, you agree to these Terms.

If you do not agree, do not use the service.

1. Service Description

CipherGap provides external TLS scanning, post-quantum key exchange readiness checks, certificate observations, monitoring, alerting, and related reporting for submitted internet-facing hosts.

CipherGap is an informational security tool. It does not guarantee that any system is secure, compliant, fully post-quantum, or free from vulnerabilities.

2. Account Registration

You may need an account to use certain features.

You agree to:

  • Provide accurate account information.
  • Keep your account credentials secure.
  • Promptly notify us of unauthorized access.
  • Be responsible for activity under your account.

We may suspend or terminate accounts that provide false information, create operational risk, violate these Terms, or misuse the service.

3. Authorization to Scan

You may only scan, monitor, or submit hosts, domains, IP addresses, or systems that you own, administer, or are authorized to assess.

By submitting a target to CipherGap, you represent that you have sufficient authorization to scan that target.

You may not use CipherGap to scan third-party systems without permission.

4. Acceptable Use

You agree to follow the CipherGap Acceptable Use Policy.

You may not use CipherGap to:

  • Violate law.
  • Interfere with systems you do not own or administer.
  • Harass, threaten, or target others.
  • Perform unauthorized reconnaissance.
  • Attempt exploitation.
  • Conduct denial-of-service activity.
  • Evade security controls.
  • Abuse rate limits.
  • Misrepresent your authorization.
  • Resell or redistribute CipherGap without permission.

5. Scan Results

CipherGap scan results are based on externally observable behavior at the time of testing.

Results may be affected by network conditions, CDN behavior, DNS changes, geographic routing, TLS configuration, client compatibility, certificate rotation, or temporary service issues.

CipherGap does not guarantee that results are complete, current, accurate for all clients, or representative of internal systems.

You are responsible for validating results before making operational, compliance, legal, or risk decisions.

6. Plans, Billing, and Payment

Some CipherGap features may require a paid subscription.

By purchasing a paid plan, you authorize us or our payment processor to charge applicable fees.

Unless otherwise stated:

  • Fees are billed in advance.
  • Fees are non-refundable except where required by law or expressly stated.
  • You are responsible for applicable taxes.
  • We may change pricing with reasonable notice.
  • Your access may be reduced, suspended, or terminated if payment fails.

7. Free Plans and Trials

CipherGap may offer free plans, trials, or promotional access.

We may modify, limit, or discontinue free plans or trials at any time.

Free plans may have limits on monitored hosts, scan frequency, retention, support, and available features.

8. Customer Data

You retain ownership of hostnames, scan targets, scan results, and other information you submit to CipherGap.

You grant CipherGap permission to process Customer Data as needed to:

  • Provide the service.
  • Generate scan results.
  • Maintain scan history.
  • Send alerts.
  • Prevent abuse.
  • Improve reliability and security.
  • Comply with law.

We do not claim ownership of your Customer Data.

9. Service Availability

We aim to provide a reliable service, but CipherGap may be unavailable due to maintenance, outages, third-party provider issues, security incidents, or other conditions.

We do not guarantee uninterrupted or error-free service unless a separate written agreement states otherwise.

10. Changes to the Service

We may add, remove, modify, suspend, or discontinue features.

We may update scanner logic, grading models, algorithms, probes, scan frequency, retention, and alert behavior as the product evolves.

11. Third-Party Services

CipherGap may rely on third-party providers for hosting, payment processing, email delivery, analytics, monitoring, and other operations.

We are not responsible for third-party services outside our control.

12. Beta and Experimental Features

Some features may be labeled beta, preview, experimental, or early access.

These features may be incomplete, inaccurate, unstable, or changed without notice.

Use beta features at your own risk.

13. Intellectual Property

CipherGap and its software, design, branding, scanner logic, content, and documentation are owned by CipherGap or its licensors.

These Terms do not grant you ownership of CipherGap intellectual property.

You may not copy, modify, reverse engineer, resell, or create derivative works from CipherGap except as allowed by law or with our written permission.

14. Feedback

If you provide feedback, suggestions, ideas, or recommendations, you grant CipherGap a non-exclusive, worldwide, royalty-free right to use that feedback without restriction or compensation.

15. Confidentiality

If either party receives non-public information that a reasonable person would understand to be confidential, the receiving party must use reasonable care to protect it and may only use it for the purpose for which it was provided.

Confidentiality obligations do not apply to information that is public, independently developed, rightfully received from another source, or required to be disclosed by law.

16. Disclaimers

CipherGap is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and security.

CipherGap does not guarantee that:

  • A scan result is complete or error-free.
  • A monitored host will always be checked at a specific time.
  • An alert will always be delivered.
  • A system is secure.
  • A system is compliant.
  • A system is fully post-quantum safe.
  • A result will match every client, region, network, or internal architecture.

17. Limitation of Liability

To the maximum extent permitted by law, CipherGap will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, security incidents, or procurement decisions.

To the maximum extent permitted by law, CipherGap’s total liability for any claim related to the service will not exceed the amount you paid to CipherGap in the twelve months before the claim arose, or $100 if you used only a free plan.

18. Indemnification

You agree to defend, indemnify, and hold harmless CipherGap from claims, damages, liabilities, losses, and expenses arising from:

  • Your use of the service.
  • Your violation of these Terms.
  • Your violation of the Acceptable Use Policy.
  • Your scanning of systems without authorization.
  • Your violation of law.
  • Your Customer Data.

19. Suspension and Termination

We may suspend or terminate access if:

  • You violate these Terms.
  • You violate the Acceptable Use Policy.
  • Your use creates security, legal, operational, or reputational risk.
  • Payment fails.
  • We are required to do so by law.
  • We discontinue the service.

You may stop using CipherGap at any time and request account deletion by contacting support@ciphergap.com.

20. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

Any disputes will be resolved in the state or federal courts located in Hamilton County, Indiana / Marion County, Indiana / applicable venue, unless otherwise required by law.

21. Changes to These Terms

We may update these Terms from time to time.

If changes are material, we will provide reasonable notice through the service, by email, or by another reasonable method.

Your continued use of CipherGap after updated Terms become effective means you accept the updated Terms.
